1. Acceptance of Terms

These Terms and Conditions govern your access to and use of the Buster's Pizza & Donair website at https://busterspizza.com, mobile app, and online ordering services, operated by Buster's Pizza & Donair USA, Inc. . By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

2. Eligibility

You must be at least 18 years old to create an account or place an order through our Services. By using our Services, you represent that you meet this requirement.

3. Franchise Locations

Many Buster's restaurants are independently owned and operated by franchisees. While these Terms govern your use of our digital Services, individual restaurant policies (such as in-store conduct rules or local promotions) may vary by location.

4. Account Registration

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at legal@busterspizza.com if you suspect unauthorized use of your account.

5. Online Ordering, Pricing & Payment

  • Prices, menu items, and availability are subject to change without notice and may vary by location
  • We make reasonable efforts to ensure menu and pricing accuracy but do not guarantee it; the restaurant fulfilling your order has final say on order details
  • Payment is processed through our third-party payment processor. By placing an order, you authorize us to charge your selected payment method.
  • Orders are subject to acceptance and may be canceled or refused, including for suspected fraud, item unavailability, or errors in pricing
  • Delivery times are estimates only and are not guaranteed

6. Delivery Partners

Orders placed for delivery may be fulfilled through third-party delivery partners, such as DoorDash, Uber Eats, etc. Use of these services may also be subject to that partner's own terms and conditions.

7. Promotions, Coupons & Rewards

Any discounts, coupons, or loyalty/rewards program benefits are subject to additional terms disclosed at the time of the offer, and Buster's may modify or discontinue such programs at its discretion, subject to applicable law

8. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to our systems, other users' accounts, or non-public areas of the Services
  • Interfere with or disrupt the operation of the Services (e.g., via malware, bots, or scraping)
  • Submit false, fraudulent, or duplicate orders
  • Post or transmit content that is defamatory, obscene, or infringes on others' rights (e.g., in reviews or contest entries)

9. Intellectual Property

All content on the Services — including the Buster's name, logo, recipes, photography, and site design — is owned by or licensed to Buster's and protected by copyright, trademark, and other laws. You may not copy, reproduce, or use this content without our prior written permission, except as necessary to use the Services for their intended purpose.

10. User-Generated Content

If you submit reviews, photos, contest entries, or other content ("User Content"), you grant Buster's a non-exclusive, royalty-free, worldwide, transferable license to use, reproduce, and display that content in connection with our business and marketing, and you represent that you have the rights to grant this license.

12. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BUSTER'S AND ITS FRANCHISEES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE ORDER GIVING RISE TO THE CLAIM.

14. Indemnification

You agree to indemnify and hold harmless Buster's, its franchisees, and their respective officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Services.

15. Governing Law

These Terms are governed by the laws of the State of Wyoming (WY), without regard to conflict-of-law principles, except where superseded by applicable federal law or the law of your state of residence where required.

16. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms. Material changes will be reflected by updating the "Last updated" date above.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
